1. Presentation

The purpose of these general terms and conditions of sale is to govern the contractual relationship between the company Cristal Cabriolet and the end customer, user of the website Cristal-Cabriolet.fr. Any order validated on our website implies acceptance of these terms and conditions, which define the sales framework as well as the rights and obligations arising therefrom.

The sales contract for a product purchased on the website consists of the general terms and conditions of sale in force at the time of the order and the order form. You are invited to read them before validating your order. Furthermore, you acknowledge that you have full legal capacity to commit yourself under these general terms and conditions of sale.

2. Products on the website

The essential characteristics of the products offered for sale are presented on the website. Photographs, texts and technical data sheets are the property of Cristal-Cabriolet.fr.

3. Product prices

The prices displayed on the website Cristal-Cabriolet.fr are expressed in Euros and include shipping costs (except for certain countries, see the website). They may be modified at any time without prior notice. In the case of on-site collection, no discount will be applied. The prices applied are those in force at the time of the order, subject to available stock and excluding typographical errors or changes to the French tax regime applicable to Auto-Entrepreneurs. Any change in rates will be immediately reflected in the sale prices. All orders will be invoiced inclusive of taxes (VAT included); depending on the country of delivery, customs duties, taxes and fees may be claimed from the customer by the delivery companies.

4. Orders

To validate an order, you must first identify yourself. For this purpose, you complete, according to the instructions provided online, a form made available to you in which you provide the information necessary for your identification, in particular your last name, first name, telephone numbers, postal and email addresses, as well as billing and delivery addresses. You then definitively validate your order by clicking on the "Validate order" button to express your commitment and acceptance of the general terms and conditions of sale. From that moment, the order is recorded and an order number is communicated to you, together with confirmation on screen and/or by email. The data recorded by the company Cristal Cabriolet constitute proof of the nature, content and date of the order.

For any modification of an order after online validation, you are invited to contact our customer service by email or by telephone via the "Contact us" section. The invoice includes details of the price of each product inclusive of taxes.

5. Transaction security

In order to secure the transactions carried out on our website and to combat credit card fraud, the information transmitted in connection with your order is processed via PayPal in order to determine a maximum level of reliability. For this reason, we may ask you by email to provide proof of your identity and address, in order to protect you against fraudulent transactions. Through these supporting documents, we guarantee enhanced security by ensuring that you are indeed the holder of the credit card used. In the case of orders paid by cheque or bank transfer, supporting documents corresponding to the order addresses and the cheque holder may also be requested, always with the aim of guaranteeing maximum transaction security.

8. Right of withdrawal

From the delivery date of your order, if you are a private individual, you have a period of 14 clear days to exercise your right of withdrawal by returning the unopened and unused package within this period (French Consumer Code Article L121-20), and to receive a refund (fees will be deducted depending on the order amount). In the case of a complete return of your order, the return shipping costs remain at your expense. However, products returned incomplete, damaged, worn or soiled will not be accepted. The withdrawal period does not apply to sales made with immediate collection.
In order to facilitate proper management of returns within the withdrawal period, you may contact Cristal Cabriolet by email or by telephone. An email will then be sent to you explaining the procedure for returning your order. This formality does not suspend the deadline for returning the package within 14 clear days after delivery.

Restrictions on the right of withdrawal

In accordance with Order No. 2001-741 of 23 August 2001, this withdrawal period does not apply to:

  • Products supplied on request.
  • Special orders (references outside the catalogue).

9. Warranty and after-sales service

All products sold on Cristal-Cabriolet.fr are guaranteed for one year return-to-workshop, covering the quality of stitching, the durability of the materials including the transparent plastic, its transparency and its non-alteration during this period. Waterproofing is not included in the warranty criteria insofar as it depends on proper installation of the product by the customer on the vehicle. A replacement fastener may be supplied and will be invoiced in the event of damage caused by the customer. The zipper (zip fastener) of each product is designed to be installed on the corresponding vehicle; any damage resulting from improper handling during installation on your vehicle will not be covered by any warranty.

Any return of goods outside the withdrawal period requires our prior agreement, and the product reference must be clearly indicated on any returned package. You are therefore invited to submit a return request via your personal account, after which an email will specify the procedure for returning the defective product. Goods are returned at your expense, risk and responsibility. Products returned by carrier without physical protection or inadequately protected will not benefit from the warranty, as will damaged, worn or soiled products. It is therefore your responsibility to ensure that the returned product(s) are properly protected and insured during transport. You are responsible for retaining the packaging and accessories supplied with the product, which are required to benefit from the warranty offered.

In the event of return of a non-defective product, a flat-rate handling fee of €20 excluding tax will be charged. Please therefore carefully check before any return that your issue is not due to improper installation or incompatibility with your vehicle. In the event that additional intervention proves necessary (non-compliant installation, unsuitable or severely damaged hood, etc.), Cristal Cabriolet cannot intervene for legal reasons due to its Auto-Entrepreneur status, which does not allow the invoicing of services.

10. Retention of title and liability

The company Cristal Cabriolet retains ownership of the goods until full payment has been made. Ownership of the products is transferred upon full payment of the price. However, during the period between delivery and transfer of ownership, the risks of loss, theft or destruction remain at your expense.
Failure to fulfill your payment obligations, for any reason whatsoever, entitles the company Cristal Cabriolet to demand immediate return of the delivered goods at your expense, risk and responsibility. In the event of judicial reorganization proceedings affecting your business, you undertake to actively participate in the establishment of an inventory of the goods held in your stock and claimed as property by the company Cristal Cabriolet. Failing this, the company Cristal Cabriolet may have the inventory recorded by a bailiff at your expense. You agree not to resell, transform or incorporate the delivered goods from the date of the judgment pronouncing the judicial reorganization or liquidation of your business. The company Cristal Cabriolet may prohibit resale, transformation or incorporation of the goods in the event of late payment. To guarantee unpaid amounts, in particular the balance of your account in the records of the company Cristal Cabriolet, it is expressly stipulated that the rights relating to delivered but unpaid goods shall be transferred to identical goods originating from the company Cristal Cabriolet held in your stock, without the need to allocate payments to a specific sale or delivery. In the event of a claim, any deposits already paid shall remain with the seller as compensation.

11. Confidentiality of banking data and transaction security

The website Cristal-Cabriolet.fr, represented by the natural person David GARNIER, undertakes to protect your personal data and your privacy. Failure to transmit such data prevents the completion and analysis of your transaction.

In the context of payment via a PayPal account, certain information is transmitted to the partner organization PayPal. In this respect, and with the exception of operations carried out on its own behalf, PayPal prohibits any dissemination and/or commercialization of this personal data. The occurrence of an unpaid transaction due to fraudulent use of a credit card will result in registration in a database. An irregular declaration or an anomaly may also be subject to specific processing. Furthermore, to comply with tax and legal obligations, a paper and electronic copy of each invoice will be kept for 10 years by the company Cristal Cabriolet. Contractual information is presented in the French language and the products offered for sale comply with French regulations. Where applicable, it is your responsibility as a foreign customer to check with local authorities the possibilities of use of the product you intend to order. The company Cristal Cabriolet cannot be held liable in the event of non-compliance with the regulations of a foreign country.
